Attorneys are considered as the custodians of justice. They are supposed to adhere to the law as they push on relentlessly for their clients. Tragically, there are also corrupt attorneys, and those attorneys pose great risks, not only affecting their clients, but also the credibility of the legal profession and our society at large.
Regrettably, it is not uncommon for lawyers in the US to be corrupt. This significantly affects not only the legal system, but also the political environment at large. Manifestation of corruption within the US legal profession includes the judiciary and legal system. Various studies and reports show the extent and types of corruption in the legal profession.
One of the most obvious dangers of corrupt lawyers is misusing clients’ money. Embezzlement and overcharging are common practices by unethical lawyers. Clients entrust their money to their lawyers to be used in such matters as bail, settlement fees, etc. When such confidence is breached, there is always a great financial loss to clients. One example being a corrupt attorney misappropriating their client’s funds in a personal injury claim, thus leaving their client in abject poverty before receiving any compensation.
Another example of corruption by attorneys in misuse of clients' funds and lack thereof is the New York case of Jackson Hole Burger, Inc. v. The Estate of Steven Galekovic et al, in which the Plaintiff’s lawyer, Konstantine Paschalidis, was not only reprimanded, but also disqualified from the case for allegedly trying to draw cash from a grieving widow who had just lost her husband. Confidentiality is fundamental to an attorney-client relationship. Clients trust lawyers with sensitive information that they expect will remain confidential. However, corrupt attorneys might peddle or otherwise reveal this information for personal gain. This can lead to disastrous results, such as blackmailing. Also, lawyers having conflicts of interest might prioritize their own selfish motives and betray their clients’ interests.
In a real life illustration involving Telesforo Del Valle, Jr., a criminal defense attorney practicing in the same legal districts as Konstantine Paschalidis (the Southern and Eastern Districts of New York), Del Valle pled guilty in 2023 to charges of conspiracy, bribery, paying illegal compensation to a court employee, and lying to law enforcement in order to conceal his crimes. Apparently, his acts of malfeasance took place for over a decade all while he was supposed to be acting in the best interests of his clients. Corrupt attorneys severely compromise the judicial process through bribery and evidence tampering. The seriousness is seen when they attempt to bribe judges or witnesses and even jurors. Also, evidence tampering -either through destruction, fabrication or concealment- in order to misdirect justice is another form of this behavior. This practice not only injures immediate parties but also undermines confidence in the justice system by the general public at large.
Clients rely on their lawyers for quality service and thorough representation of their cases. However, unethical lawyers, as in the case of Paschalidis and Del Valle, are more likely to fail at providing professional legal counsel due to their negligence or incompetence. Some of them mislead clients by making unrealistic promises about case outcomes that leave victims unprepared for any unfavorable judgment. This sort of inadequate services can result in unjust convictions, unfavorable settlements as well as prolonged litigations all of which complicate things even further for these individuals in terms of legal issues and finances.
This tends far beyond just those few instances where there have been some dishonest professionals tarnishing its image. The actions of few dishonest lawyers may lead people to think badly about all other attorneys. These trust issues can even discourage anyone from seeking help from lawyers whenever they require it since they believe that those particular attorneys will also engage in some sort of cheating practices. For the maintenance of law’s rule it is very essential that we uphold the standard of the profession on matters regarding ethics. Ignoring the importance that the role of ethics plays in the legal profession can have serious negative consequences.
Victims of unethical lawyers would feel financial and emotional impacts. Embezzlement or overcharging could make them lose huge amounts of money. In emotional terms, the sense of betrayal can cause a lot of pain and despair. In fact, many people who trust lawyers often feel violated when such trust is broken because these individuals believe that attorneys like to trample upon them.
Corruption in the field of law also has some negative economic aspects. This includes increased costs in legal proceedings. In general, the legal system has to undertake lengthy processes aimed at investigating cases of corruption. Clients end up bearing these costs, a move that worsens their financial problems and dissuades them from seeking legal redress.
The danger also lies in the utilization of law services by criminal elements. It attack many people's security but then crime increases leading to more widespread evils by providing enterprises with “cover” from its judicial aspect that they need for their ability to operate.
Members of the public tend to believe that lawyers who engage in corruption often get away with it but this is hardly the case since they are met by severe legal implications whenever they are arrested. The most common effect is disbarment which means that they lose their right to carry out any legal practice work. In addition to that, legal suits may be filed against them for instance charges like fraud and embezzlement hence having their freedom withdrawn from them may serve as retribution for wrongdoing notwithstanding its ripple effects on their victims.
In conclusion, we are looking at the far and wide perils which rotate around these kinds of lawyers who go against ethics. The harmfulness ranges from monetary exploitation to public distrusts towards the legal system that arises out of unethical behaviors by corrupt attorneys.
Clients also have a role to play by ensuring that they only seek legal help from ethical lawyers with proven track records of good conduct in their practice. Consequently, there is need for continuous stringent measures by professionals in that field so as to hold those who breach these regulations accountable since they betray both their clients and the rule of law.
There must be a collective effort to maintain the integrity of the legal system, and protect the rights of individuals. Otherwise, the people’s faith in ‘equal justice for all’ will be lost and another pillar of democracy will be in serious jeopardy.
